In reality, a proposal for a directive on procedural safeguards for children who are suspected or accused in criminal proceedings is more than needed. Child’s mentality is weak and can be easily upset therefore we should protect them. In order this to happen, member states should implement directive that states that suspects and accused children are presumed innocent until proven guilty under the law. Furthermore, directive on procedural safeguards for children who are suspected or accused in will enhance the right to a fair trial in criminal proceedings by laying down minimum rules and presumption of innocence and the right to be present at the trial.
